Recently, High Mark partner Grace Shi'sarticle “The Connection between DAB Mechanism and Arbitration Procedures underFIDIC Contracts” won the first prize of the 7th “Zhong Lun Cup” for NationalEssay Competition on International Commercial Arbitration, which was jointlyorganized by the China International Economic and Trade Arbitration Commission(CIETAC), Renmin University of China, the All China Lawyers Association and theBeijing Lawyers Association.

    “Zhong LunCup” for National Essay Competition on International Commercial Arbitration iscurrently the highest level, most widely participated and most influentialacademic essay competition in the field of international commercial arbitrationin China. The article “The Connection between DAB Mechanism and ArbitrationProcedures under FIDIC Contracts” aims to discuss the original intention anddevelopment trend of DAB Mechanism, basing on typical arbitration cases, to analyzethat an arbitral tribunal can make a partial or interlocutory award, withoutsubstantive review of the DAB decision, ordering a party to enforce a bindingbut not final DAB decision. In the meanwhile, to further ensure the connectionbetween DAB mechanism and arbitration procedures, it proposes suggestions onthe drafting and implementation of the special clauses of DAB Mechanism underthe FIDIC Conditions of Contract.
